CNN —The Arizona House of Representatives voted Wednesday to overturn the state’s 160-year-old abortion ban, setting the stage for a repeal that would leave the state’s 15-week restriction on the procedure in place. CNN —The Republican-controlled Arizona House of Representatives once again failed to advance a repeal of the state’s 160-year-old abortion ban Wednesday, days after the state Supreme Court roiled state politics by reviving the law. On Wednesday, following two attempts to discuss a bill that would repeal Arizona’s 1864 ban on abortions, lawmakers voted not to discuss the measure on the House floor. State lawmakers last week ended a House session early to block an effort to repeal the abortion ban. Last Monday, Donald Trump said that abortion rights were best left to the states. “The states,” he said, “will determine by vote or legislation or perhaps both, and whatever they decide must be the law of the land. In this case, the law of the state.”The next day, as if answering a captain’s call to fire from the line, the Republican-led Arizona Supreme Court, in an uncanny coincidence, revived a 160-year-old abortion ban, with no exceptions for either rape or incest. In a 4-to-2 decision, the court held that the 1864 ban was “enforceable” and not superseded by more recent legislation. It does not escape my attention that this law owes its rebirth to an effort by Doug Ducey, then the governor, to expand the Arizona Supreme Court’s membership from five to seven justices.

Governor Ducey defended the results of Arizona’s 2020 election, he certified the election, and he made it clear that the certification provided a trigger for credible complaints backed by evidence to be brought forward.

Housing plans for upwards of 800,000 people in Arizona might be put on hold because of the state's challenge with water. Newly elected Governor Katie Hobbs made a point to recognize the state's water struggles in her State of the State address on January 9. The state water finance board is reviewing plans for a new water desalination plant, which could help convert groundwater or water imported from Mexico into usable water. However, researchers like Kathleen Ferris at Arizona State university say the plant probably won't be available in time to mitigate the water shortage that Arizona is already experiencing. "We should not be allowing this growth to occur when the water isn't there," Ferris told the Arizona Republic.

A Virginia bill would deem a pregnant person's fetus a passenger in a car, thereby allowing the vehicle to use the car pool lane on highways. Under the bill, the certifications would then be "linked" to toll collection devices — typically E-Z Passes — in vehicles. High occupancy lanes require drivers to have at least one passenger in their vehicles when they use the lanes. And by considering a pregnant person as two people — in this case, allowing a pregnant person to use an HOV lane — you're ultimately making it harder to uphold abortion rights, because you have essentially imbued a fetus with personhood," Nash added.
